API/Data Licence

1. The Service

simlir is a product data API. We maintain a structured product database and provide access to it via a REST API and an MCP server for integrations. The service is provided by simlir Ltd, a company registered in England and Wales.

This API/Data Licence governs your use of the simlir API, simlir dashboard, and any licensed response data you receive through them. General use of simlir.com is covered by our Website Terms.

2. No Warranty on Data

simlir provides product data without warranty of any kind.

• Product specifications are structured from public retailer pages and may contain errors.
• Prices are snapshots at the time of ingestion and may not reflect current retailer pricing, promotions, or stock availability.
• Embedding-based search results are approximate matches, not guarantees of relevance.
• You should always verify product data directly with the retailer before making business decisions based on it.

3. API Usage & Credits

Access to the simlir API requires an account and API key. Each API key is issued to a specific customer account, must be kept confidential, and may only be used for that account's authorised use of the service. API calls are billed in credits, deducted from your account balance. Credit pricing and rate limits are published on the dashboard and may change with reasonable notice.

Purchased credits are non-refundable except where required by law. Unused credits do not expire while your account remains active.

New eligible accounts receive a one-time 10,000-credit welcome grant. Existing eligible accounts may receive the approved one-time retroactive grant. Subscription grants, purchased credits, free grants, and migrated legacy balances are tracked as separate ledger sources but are spendable from one account balance. Credits are allocated from the source ledger on use and are never silently reset at the end of a month.

The Developer subscription is a recurring monthly service. It grants 10,000 credits only after a successful invoice and has full rollover. One active Developer subscription is permitted per account. A failed payment starts a seven-calendar-day recovery period; update the payment method through the billing portal during that period. We do not grant a new subscription period until its invoice is paid.

Subscription cancellation normally takes effect at the end of the paid period, and the account can continue using its remaining credits until then. Any mandatory cancellation, cooling-off, refund, or other consumer right overrides this default where applicable. Where a lawful refund is due after credits have been used, we may account for the value of the delivered service to the extent permitted by law and the agreed contract.

Prices are displayed in GBP as a base price. Tax is calculated at checkout from the supplied billing country, address, customer type, and any optional tax or VAT number; where consumer law requires an inclusive total, the checkout shows it before payment. A customer does not need to be VAT-registered to buy; a missing VAT number does not by itself prevent payment. The checkout record and invoice provide the transaction evidence and tax treatment for the purchase. Customers are responsible for supplying accurate billing information and obtaining their own tax advice.

We may apply quotas, pagination caps, endpoint restrictions, concurrency limits, and other usage controls to protect the service. Bulk exports, dataset delivery, or similar high-volume access require a separate written licence.

4. Data Use & Licensing

Data returned by the simlir API is licensed, not sold. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use API responses in your own application, service, or internal systems.

Permitted use includes displaying, combining, and processing results inside your own product or internal workflows for your own business purposes or for your own end users as part of your service.

You may not resell, sublicense, publish, expose, or otherwise make raw simlir data available to third parties as a standalone feed, dataset, or competing service. You may not store, aggregate, or retain a substantial portion of the service to build, refresh, or support a substitute database or similar competing product without our prior written permission.

You may keep reasonable operational copies or caches only as needed to support your own product experience for your own end users in compliance with these terms. You may not expose raw API responses, bulk exports, or retained response archives to third parties, and you may not use stored responses to avoid ongoing authorised access to the service.

Unless we agree otherwise in writing, you may not use the service or any substantial portion of its output to train, fine-tune, benchmark, or improve any machine learning, foundation model, embedding model, or similar automated system.

On reasonable request related to suspected misuse or breach of these terms, you will provide information reasonably necessary to verify compliance and cooperate with our investigation.

5. Acceptable Use

You agree not to:

• Attempt to scrape, mirror, or bulk-download the service beyond documented API access.
• Use the API to build or populate a competing product database.
• Store or warehouse raw API responses to create a resale feed or substitute service.
• Use the service to train or improve models except under a separate written licence.
• Share API keys or allow unauthorised access to your account.
• Remove, conceal, or interfere with technical identifiers, audit markers, or anti-abuse controls.
• Attempt to bypass rate limiting, authentication, or other security measures.
• Use the service for any unlawful purpose.

We may monitor usage patterns, maintain request and account logs, investigate suspected abuse, and use automated systems to detect misuse, excessive extraction, or suspicious access. We may throttle requests, deny suspicious traffic, revoke API keys, and suspend or terminate accounts that violate these terms.

If we reasonably suspect misuse, you must promptly cooperate with our investigation, including confirming relevant use cases, deployments, and account ownership.

Unauthorised copying, warehousing, or resale of the service may cause irreparable harm. We reserve the right to revoke keys immediately, suspend or close accounts, refuse or limit future access, deny refunds where lawful, preserve logs and other evidence, pursue injunctive relief, recover damages and fees for unauthorised use, and seek any other remedies available under contract or law.

6. Limitation of Liability

To the maximum extent permitted by applicable law, simlir Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.

simlir is not responsible for decisions made based on data returned by the API. Product data is provided “as is” and should be independently verified for business-critical use cases.

7. Intellectual Property

The simlir name, logo, API, and database are the property of simlir Ltd. Product information sourced from public retailer pages is attributed to the original retailers and is processed under fair-use principles for the purpose of creating structured data.

8. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of simlir after changes constitutes acceptance of the revised terms.

9. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
